The highest bidder whose bid is accepted by the Auctioneers shall be the Purchaser and no Purchaser shall retract his bid. Complete payment MUST be made Auction day, Cash, Check or Credit Card for Gardens Alive 1! Farm Equipment Auction Wednesday, August 8, 2018. No items may be removed until paid for in full. The auction is being recorded.
ALL ITEMS SELL “AS IS – WHERE IS”. THERE SHALL BE NO GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE AS TO THE MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OF ANY GOODS OFFERED IN THIS SALE. ALL SALES MADE ON AN “AS IS – WHERE IS” BASIS WITH ALL FAULTS.
*** PLEASE NOTE ***Please inspect all items before bidding. You will for no reason be allowed to retract your high bid. NO EXCEPTIONS.
***PLEASE NOTE***Auction Company lists the options that the item may have, however due to limited capabilities, all options have not been tested or verified to be in working condition. Operating condition of vehicles (including autos, trucks, semis, recreational, etc.) and/or options of same, Auction Company does not conduct a road test, nor are the vehicles inspected for mechanical defects. Testing is limited to driving vehicle within our auction facility lot only. Please rely on your own inspection prior to bidding.
*** PLEASE NOTE ***If for any reason whatsoever, the Auctioneers fail to deliver clear title or possession on an awarded lot, the Auctioneers’ sole liability shall be the return of any monies paid on such non-delivered lot, and the purchaser shall have no further claim.
SALES TAX:
No sales tax will be charged except on titled/over the road.
All purchases of titled vehicles will also be charged a 6% Michigan State Sales Tax. For exemption from sales tax you will be required to fill out a tax exemption form with a valid dealer’s resale #. (NO EXCEPTIONS)
Please note: On items that we do not have to charge sales tax for at the auction site, you may still be responsible to pay use tax to the State of Michigan, please check with your accountant or tax attorney to determine your responsibility for further sales or use tax.
NOTE TO BUYERS OF TITLED VEHICLES
State regulations require that we broker all vehicles sold, therefore you must sign your paperwork in the auction office. A $95 broker fee will be charged for paperwork. In addition, a $15 title application fee will be collected for the State of Michigan (Dealers are exempt from the title application fee ONLY) Miedema Auctioneering will then process your titles. If you wish to plate your vehicle there will be an additional fee. Proof of insurance will need to be provided for removal.
SECURITY/RELEASE SLIP
A copy of the invoice showing payment in full on your purchases will be required before any items will be allowed to be removed from the Auction premises. This slip will be given to you by the office personnel once you pay your invoice in full.

Thursday, August 9 and Friday, August 10 – 8:00 AM – 5:00 PM
Monday, August 13 thru Tuesday, August 14 – 8:00 AM – 5:00 PM. No Sunday removal please.
LOAD OUT
All buyers will be responsible for loading their plants or equipment.
(NO auction company loading services or equipment will be available)
LIABILITY
Every person at the Auction site before, during and after the Auction sale shall be deemed to be there at his/her own risk. No person shall have any claim against the Auctioneers, or sellers, their agents, employees or principals for any injuries sustained for damages to or loss of property which may occur from any cause whatsoever.
CATALOG INFORMATION
All information given during the Auction and listed in the Auction catalog was received from reliable sources and is assumed to be correct; however, the Auction Company and the owners do not guarantee the accuracy or genuineness of the information and are not responsible for any misprints or misinformation in the Auction catalog or as stated during the Auction. Please inspect all items before bidding. Any statements made the day of the Auction take precedence over all printed material. Please review back of bidder’s card.
BUYERS PREMIUM: A 8% Buyer’s Premium will be added to purchases. If paying with cash, personal or company check, cashier’s check or wire transfer the 3% will be waived (making the Buyer’s Premium 5%).
**Also please note: Bid Spotter Buyer’s Premium will be 10% with a 3% discount for paying with cash, personal or company check, cashier’s check or wire transfer. **

*** PLEASE NOTE *** There are lot numbers of nursery plants in the catalog that only certain approved nurseries can bid on – most of these lots will be ‘A’ lots, for example 634A and 635A. The approved nurseries are listed on a sperate handout.
